Once a complaint is initiated against your license, the investigating department (most likely a consumer services unit) is likely to either issue a non-disciplinary citation, close the complaint or continue with an investigation. Should a full blown investigation occur, the complaint may be forwarded to legal services where the complaint will be assigned to a state prosecutor to review. The attorney will either close the complaint out for reasons such as insufficient evidence or non-jurisdiction.

 

In the alternative, the state prosecutor may elect to draft an administrative complaint. In most circumstances, the administrative complaint needs to be adopted by the Board of that associated profession to determine probable cause. Once an administrative complaint is filed against a licensee, that licensee will be notified of the complaint and asked to file an election of rights form where an election needs to be made. 

 

 

The licensee should consult with an experienced attorney at the earliest point that discipline is being sought against that licensee. Timely legal expertise ensures that the licensee makes the best election in defending the allegations.
